TRICHOMAG PRIVACY

Trichomag (the 'Software') is owned by Syncode Scarl (hereinafter referred to as Syncode) which is also its manager. The use of the software is subject to the present terms of use ('Terms of Use'). If you ('User') do not intend to accept the Terms of Use, you should stop using it. By purchasing and using it, the User accepts the Terms of Use. 1.1. The Terms of Use constitute a contract between the User and Syncode and cannot be modified without Syncode's consent. These Terms of Use should be read with reference to every part of the software concerning its operation and the services available. 1.2. The use of the Site is subject to the Terms of Use. The User is also required to read Syncode's Privacy Policy. 1.3, which reserves the right to modify the Terms of Use at any time and unilaterally without any notice.

Syncode Scarl grants the User the right to install and use a copy of the software per device on an international basis for use by one person at a time, within the scope of the User’s Services, provided the latter respects these Conditions. Regarding some devices, such software may be pre-installed for personal and non-commercial use of the Services. The software or the website that is part of the Services may include third-party code. The third-party code or scripts, linked to, or referred to in, such software or website, are licensed to the User by the third-party owners of such code, not by Syncode. Any communications regarding third-party code are included for informational purposes only.

The software is licensed, not sold and Syncode reserves all rights to the software not expressly granted under these Terms. This license does not grant the User any right to, and the User may not, unlawfully:

1. circumvent or evade any technical protection measure present in the software or in the Services or related to them;

2. disassemble, decompile, decipher, modify, emulate or exploit any software or any other aspect of the Services included in the Services or accessible through them, except where such activities are expressly authorized by the applicable copyright law;

3. separate components of the software or Services to use them on different devices;

4. publish, duplicate the software or the Services, rent them, loan or lease them, sell them, export them, import them or distribute them, if not expressly authorized by Syncode;

5. transfer the software, any software licenses or any rights of access to the Services or use of them;

6. use the Services in any unauthorized way that may interfere with the use of them by others or access services, data, accounts or network;

7. allow access to the Services or modify any authorized device of Syncode through unauthorized third-party applications.

Syncode will make every reasonable effort to ensure that the information on the software is correct. Except as provided in our General Terms of Sale, Syncode does not guarantee that all information is correct, complete and updated and, to the fullest extent permitted by law, Syncode will not be responsible for any harm or damage resulting from the reliance placed on such information by the User or by third parties to whom such information has been forwarded by the User. All content of this software, including but not limited to the text, software, photographs, videos, and images, is protected by copyright. Syncode, or its licensors, are the copyright and/or database rights owners for the selection, coordination, organization and enhancement of such content, as well as the original content. Other product names or brands are owned by their respective owners. Except as expressly indicated in the Terms of Use, the User will have no rights to the intellectual property rights owned by Syncode or its licensors. The User should not assert or attempt to obtain such intellectual property rights and may not use, copy, reproduce, modify, publish, transmit, participate in the transfer or sale, create derivative works from, or in any way exploit the name of Syncode, trademarks, service marks, logo or other proprietary marks of Syncode or any other content of this Site, either in whole or in part. Except as otherwise provided by copyright laws, no copying, redistribution, transmission, publication or commercial exploitation of downloaded content will be permitted without the explicit consent of Syncode as well as that of the copyright owner of the respective intellectual property rights. In the case of authorized copying, redistribution or publication of copyrighted material, no modification or deletion of author attribution, trademark notification, legend or copyright should be made. The User acknowledges that they do not acquire any intellectual property rights by downloading copyrighted content. The rights granted to the User under the Terms of Use cease immediately upon any violation of the Terms of Use.

Many services of the Trichomag software allow the User to store or share the User's Content or receive material from others. Syncode does not claim ownership of the User's Content. The User's Content remains the property of the User, who is responsible for it.

1. When the User shares the User’s Content with others, they should be aware that these others may be able, worldwide, to use, save, record, reproduce, transmit, share and display such content for the purpose for which the User made it available on the Services for free. To not grant others such a faculty, the User should not use the Services to share the Content. The User declares and guarantees that, for the duration of these Terms, they will have all necessary rights related to the User's Content uploaded, stored or shared on or through the Services and that the collection, use and storage of the User's Content through the Services will not violate any law or any third party rights. Syncode strongly advises the User to make periodic backup copies of their Content. Syncode cannot be held responsible for the User's Content or the material uploaded, stored or shared by third parties through the Trichomag Services.

2. To the extent necessary to provide the Services to the User and others (including any modification of size, shape or format of the User's Content in order to improve its storage or display), protect the User and the Services, and improve Trichomag products and services, the User grants Syncode an international and free license in relation to intellectual property for the use of the User's Content, for example, for purposes of duplication, storage, transmission, reformatting, distribution through communication tools, and display of the User's Content in the context of the Services.

Syncode will inform the User if it intends to make changes to these Conditions.

- Syncode may modify these Conditions if necessary (i) under applicable law, including, for example, a change in such law, (ii) following a communication and/or order under applicable law, (iii) following the evolution of the Services, (iv) for technical reasons, (v) for operational requirements or (vi) to make improvements to the Conditions for the benefit of the User. Syncode will notify the User of the change before it takes effect, via the user interface, an email message or other suitable means. Syncode will give the User the opportunity to cancel the Services at least 30 days before the change comes into effect. Using the Services after the effective date of the change constitutes acceptance of the new conditions. If you do not accept the new conditions, you should stop using the Services and unsubscribe.

- Syncode may automatically check the version of the software, which is necessary to provide the Services, and download software updates or configuration changes, at no cost to the User, to update, improve and further develop the Services. It is also possible that the User will be asked to update the software to continue using the Services. Such updates will be subject to these Conditions, unless they are accompanied by additional conditions or other conditions, in which case the latter will apply. If you do not accept the additional conditions or other conditions applicable to updates, you will not be able to use or receive updates. Syncode is not obliged to make any update available nor does it guarantee to provide support for the version of the system for which you have purchased or licensed the software, apps, content or other products.

- Syncode is constantly committed to ensuring the improvement of the Services and, at any time, may modify the Services, remove features or stop access to Third Party Apps and Services, including, for example, cases where, under the contracts entered into by Syncode with third parties, Syncode is no longer allowed to make available third-party materials nor is it feasible for Syncode to provide such materials, technological advancements or customer comments indicating the need for a change. Syncode will inform the User in advance if a change to the Services prevents access to the User's Content. For paid Services, Syncode will also communicate to the User in advance other substantial changes made to the Services. Except where required by applicable law, Syncode is not obliged to allow a new download or replacement of previously purchased material, Defined Digital Products or applications.

Syncode Responsibility

- Syncode will not be responsible for the material and the User Content or third-party material, including links to third-party websites, nor the activities provided by users. Such content and activities are not attributable to Syncode nor do they represent Syncode's opinion.

- Syncode will be responsible only if substantial obligations of the Contract have been violated or where otherwise required by applicable law.

- Syncode, its delegates acting on its behalf and/or its legal representatives will not be liable for indirect damages, including financial loss, such as loss of profit, except in cases of gross negligence or wilful misconduct by Syncode, its delegates acting on its behalf and/or its legal representatives.

- Any liability for absence of errors by Syncode provided by law, including liability by law for non-fulfilment of the warranty, will not be affected by the limitation of liability. The same principle will apply to the liability of Syncode, its delegates acting on its behalf and/or its legal representatives in case of unlawful act or negligence that causes death or personal injury.

- Syncode is not responsible for any errors or delays in the fulfilment of the obligations provided for in these Conditions, provided that such errors or delays are caused by circumstances beyond Syncode's reasonable control, such as labour disputes, force majeure, wars or terrorist activities, intentional damage, accidents or compliance with the provisions of government entities or applicable laws. Syncode must strive to reduce the effects of such events and ensure the fulfilment of the remaining obligations.

Data collected

- Syncode collects and stores images voluntarily uploaded by users.

- Syncode collects and stores the user's email.

- Syncode collects and stores the user's name.

For what purpose

Such information is used by users within the context of the application. This allows us to ensure proper functionality, improve the quality of the service provided, and for any other purpose related or ancillary to the service itself. The processing of data is carried out in full compliance with current regulations on personal data protection. The images are stored securely and are accessible only by the user who sent them. Syncode does not share the images with third parties.

The User agrees to indemnify and hold harmless Syncode, its suppliers and their affiliates and related entities and their respective directors, officers, employees and agents from and against any claims, losses, damages, liabilities, and costs (including, without limitation and to the extent reasonable, attorney's fees and court costs), arising from or related to the violation of the Terms of Use or from the access or use of Syncode services by the User. The indemnity obligation preceding will survive the termination of the Terms of Use as well as the cessation of operation of Syncode services or any product or service provided by Syncode. The Terms of Use are effective until Syncode withdraws. Syncode may withdraw from the Terms of Use at any time without notice, also partially with reference to only one of the services offered by Syncode. In case of withdrawal, the User will no longer be authorized to access such Syncode services, and the rights and obligations of Users relating to the content to the waivers, indemnities to liability limitations established in the Terms of Use will survive the cessation of the effects of the Terms of Use. Syncode also has the right, to discontinue without notice and at any time some or all Syncode services or part of them or products or services offered through them, or prevent anyone from accessing or using Syncode services or part of them. The User undertakes to comply with all laws, statutes, ordinances and regulations related to the use of Syncode services and to the purchase of products or services through them. If a part of the Terms of Use should be unenforceable, all other parts will remain valid and effective between the parties. The Terms of Use are subject to the law of the Italian Republic and any dispute relating to them. All formal communications must be sent to Syncode at the email address indicated at the end of these Terms of Use.
